  • TIMBER TRESPASS

Singer Warren Zevon notwithstanding, there may be strategies for timberland owners and managers beyond his song ‘lawyers, guns, and money.’ Inadequate access, operational conflicts, needlessly burdened timberland property, and property or timber disputes can cost timberland owners and managers valuable time and money. Understanding your rights, obligations, and options is critical for timberland owners and managers who wish
to optimize their asset value.

This workshop will help you understand the law pertaining to timberlands and neighbors as well as strategies and tools to help you manage your timberlands, facilitate operations, plan for the future and address common risks. The workshop will focus on the topics listed above – each of which can have substantial impact to your assets and/or operations – and will help you identify risks, pitfalls, and opportunities in negotiating and drafting agreements pertaining to these topics.

ACCESS AGREEMENTS • EASEMENTS • RIGHTS-OF-WAY
Speakers will explain a variety of agreements and tools that provide timberland owners and others access to timberland – e.g., permits, easements, right-of-ways, mineral reservations, recreational use, and adverse possession. Speakers will also explain the opportunities and risks pertaining to conservation easements.

TIMBER TRESPASS • THEFT • ADVERSE POSSESSION
This workshop will help you understand timber trespass and identify ways to reduce your chances of being a victim or committing timber trespass. The workshop will explore what to do when a timber trespass occurs including the time limitations for asserting claims. Similarly, the speakers will consider the growing problem of illegal activity and theft of minor or special forest products from timberlands. In addition, adverse possession and tips to minimize the loss of timberland property to adverse possession will be explained.

PREMISES LIABILITY • RECREATIONAL IMMUNITY
This workshop will help you understand your liability to people who access your property as well as recreational use immunity.
